These Terms of Service ("Terms") are an agreement between you and SMS Buddy AI ("SMS Buddy", "we", "us") about your use of our text message service and our website at smsbuddyai.com (together, the "Service"). By signing up for or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

The service

SMS Buddy AI lets you chat with an artificial intelligence assistant by text message and on our website. You can ask questions, get help with everyday tasks and ask for pictures. Longer answers and pictures are delivered as links to your private chat page.

AI answers

Answers are generated by artificial intelligence and can be incomplete, out of date or wrong. SMS Buddy is not a doctor, lawyer, financial advisor or emergency service. Do not rely on it for medical, legal, financial or safety decisions; always check important information with a qualified professional. In an emergency, call 911. See also our Disclaimer.

Eligibility and your account

You must be at least 18 years old and use a mobile phone number that you own or are authorized to use. You agree to give us accurate information and to keep your private chat link and log-in codes to yourself. You are responsible for activity on your account.

Subscriptions, free trial and billing

  • Free trial: new subscribers get a free trial of 7 days. A payment card is required to start.
  • Automatic renewal: unless you cancel before the trial ends, your plan starts automatically and renews every month at the price shown at signup, until you cancel. Payments are processed by Stripe.
  • Usage limits: each plan includes a monthly number of questions and pictures. When you reach a limit, you can upgrade or wait until your next billing period. Unused questions and pictures do not carry over.
  • Changing or cancelling: you can change or cancel your plan anytime by texting ACCOUNT to SMS Buddy and following the link, from your account page, or by contacting us. After you cancel, your plan stays active until the end of the period you already paid for.

  • Price changes: we will tell you in advance about any price change, and you can cancel before it takes effect.

SMS Messaging Program and Consent

To subscribe to SMS Buddy, users must text START to our designated SMS Buddy phone number. By sending START, you consent to receive SMS messages from SMS Buddy in accordance with these Terms and Conditions.

SMS Buddy provides an AI-powered messaging service that responds to user requests. Messages may include links to pictures or other content provided by the service.

Message frequency varies based on your interactions with the service. Message and data rates may apply depending on your mobile carrier and plan.

You may opt out at any time by replying STOP. For assistance, reply HELP or contact [email protected].

Opting out of SMS messages does not automatically cancel a paid subscription. Paid subscriptions must be cancelled separately in accordance with the subscription terms above.

Carriers are not liable for delayed or undelivered messages.

Acceptable use

Please use SMS Buddy for lawful, personal purposes. You agree not to use the Service to harass anyone, to create illegal, hateful or sexually explicit content, to send spam, or to try to break, overload or misuse the Service. We may limit, suspend or close accounts that break these rules.

Your content

You keep ownership of the messages you send. You give us permission to process them, and to share them with our service providers as described in our Privacy Policy, so we can provide the Service. You may use the answers and pictures you receive for your personal purposes.

Changes to the service and these terms

We may improve, change or stop parts of the Service. We may update these Terms from time to time; we will post the new version on this page with a new "Last updated" date and tell you about significant changes. Continuing to use the Service after a change means you accept the updated Terms.

Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent allowed by law. We do not guarantee that the Service will always be available, error-free, or that every message will be delivered. To the fullest extent allowed by law, SMS Buddy will not be liable for indirect, incidental or consequential damages, and our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim.

Ending your use

You can stop using SMS Buddy at any time by cancelling your plan and replying STOP. We may suspend or end your access if you break these Terms or if we stop offering the Service.
